Court to Reexamine Decision That Permitted Former President to Send Military Forces to Oregon City

Appeals Court Concurs to Reconsider Case
The federal appeals court ruled on this week that it would rehear the legal dispute concerning the executive power with an larger group of 11 judges. The court also overturned a previous ruling from a three-judge panel that had sided with the administration.
Legal Saga Over Troop Deployment
This legal directive represents the latest turn in a long-running court case over whether the former president has the authority and valid reason to deploy national guard forces in Portland. Approximately two hundred troops have been in uncertainty since late September when the mobilization attempt was started in response to ongoing demonstrations.
Differing Viewpoints
The federal government has argued that government employees at the ICE facility in the southern part of the city were under attack, while city and state officials maintain that local officers have command of the circumstances.
Contrary to characterizations of the city as a conflict zone, locals have been posting footage of scenic paths and a vibrant culinary culture, and planning activities such as an protest bicycle event against the increased military presence.
Court Proceedings
The appeals court decision came after a federal judge in Portland enacted two temporary restraining orders this period – one blocking the federal control of the Oregon national guard, and another prohibiting the deployment of any national guard troops in the state, after efforts to evade the first order by mobilizing troops from California.
On Monday, the ninth circuit panel had put the first ruling on hold – allowing control of state troops – but the second ruling remained in place, blocking the actual deployment of the forces.
Full Panel Consideration
The latest ruling means the matter will be heard by the full court – with both rulings under review together – by a group of eleven justices.
“This ruling shows that the truth matters and that the courts are working to ensure government responsibility. The founding document limits the executive authority, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the state attorney general in a statement.
“The court is sending a definite signal: the executive leader cannot send the armed forces into US cities unnecessarily. We will continue protecting Oregon’s laws, principles, and autonomy as this legal proceeding progresses and our fight continues in the courts.”
